WHO FILES AN INCOME TAX RETURN?

The following are required to file an income tax return:

  • every entrepreneur, whether a legal entity or a self-employed person (SZČO),
  • every individual whose income for 2023 exceeded €2,461.41.

This year, the deadline for filing the income tax return is 2 April 2024. In addition to filing the tax return by the regular deadline, you can request an extension of the deadline for filing the tax return, either:

  • until 30 June 2024 without giving a reason,
  • or until 30 September 2024 if the taxpayer had income from abroad.

HOW TO EXTEND THE DEADLINE FOR FILING A TAX RETURN?

The deadline for filing the income tax return for 2023 can also be extended in 2024.

Income tax returns are filed by taxpayers, i.e. both individuals and legal entities, within the statutory deadline. This deadline for filing the tax return is set by Act No. 595/2003 Coll. on Income Tax, as amended, specifically in Section 49. Subsection 3 of this section also deals with the possibility of postponing the filing of the income tax return.

Depending on the situation, the filing of the income tax return is postponed in one of two ways:

  • The taxpayer gives notice of the extension of the deadline for filing the income tax return.
  • The taxpayer can apply for an extension of this deadline for filing the income tax return.

In both cases, the postponement is delivered to the tax administrator before the original deadline for filing the tax return expires. Which of these methods a taxpayer can use to postpone filing the tax return depends on whether they:

  • are or are not in bankruptcy,
  • are or are not in liquidation, or
  • are or are not the heir of a deceased taxpayer.

NOTICE

A notice of the extension of the deadline for filing the tax return is submitted if the taxpayer seeking to postpone the tax return is not in bankruptcy or liquidation and is not the heir of a deceased taxpayer.

APPLICATION

An application for an extension of the deadline for filing the tax return is submitted if the taxpayer seeking to postpone the tax return is in bankruptcy or liquidation, or is the heir of a deceased taxpayer.


WHY IS IT WORTH POSTPONING?

Many taxpayers postpone filing their tax return, mostly for two reasons:

  1. their advance income tax payments come out higher,
  2. they want to postpone the obligation to pay income tax,
  3. self-employed persons want to extend their “contribution holiday”.

CALCULATOR FOR WORKING OUT ADVANCE TAX PAYMENTS

An updated tax calculator is now available on the portal of the Financial Administration (Finančná správa). Taxpayers can use this calculator to work out the amount of the advance personal and corporate income tax payments they will pay in 2024:

TAX RETURNS ACCEPTED OUTSIDE TAX OFFICES AGAIN THIS YEAR

This year, tax office staff in thirteen towns across the Slovak Republic will also accept tax returns outside their offices, on 26 and 27 March 2024 from 8:00 to 15:00 or 16:00. In addition, a mobile office will be available in the car park of the Plus Centrum complex on Panónska cesta in Bratislava on 2 April 2024 from 8:00 to 18:00.
